     1.    3414 46th Street West (BZZ #6584, Ward 13) (Andrew Liska)
     Staff report and written materials.
Variance A: Al Theisen has applied for a variance to reduce the required front yard setback from 20 feet to 12.5 feet to allow for the construction of a new single family dwelling at 3414 46th Street West in the R1A Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt findings and approve the application for a variance to reduce the front yard setback from 20 feet to approximately 12.5 feet for the construction of a new single family dwelling located at 3414 West 46th Street, subject to the following conditions:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by June 19, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The front yard setback of 12.5 feet is for the garage and roof deck only; the dwelling unit shall not be closer than approximately 16.5 feet to the front property line.
Variance B: Al Theisen has applied for a variance to reduce the required side yard setback on the west side from 5 feet to .3 feet to allow for the existing garage and rooftop deck to be incorporated into the new home.
Staff recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt findings and approve the application for a variance to reduce the west interior side setback from 5 feet to approximately .3 feet for the construction of a new single family dwelling located at 3414 West 46th Street, subject to the following conditions:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by June 19, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The west interior side yard setback of .3 feet is for the garage and roof deck only; the dwelling unit shall conform to district setbacks.
Variance C: Al Theisen has applied for a variance to reduce the required side yard setback on the east side from 5 feet to 4.2 feet to allow for the construction of a new single family dwelling at 3414 46th Street West in the R1A Single-Family District.
Staff recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt findings and approve the application for a variance to reduce the east interior side setback from 5 feet to approximately 4.2 feet for the construction of a new single family dwelling located at 3414 West 46th Street, subject to the following conditions:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by June 19, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
     2.    3721 39th Street West (BZZ #6560, Ward 13) (Joe Giant)
     Staff report and written materials.
Nesbitt Coburn has applied for a variance to reduce the established front yard setback along Ewing Ave S from 40 feet to 38 feet to allow for the construction of a new single-family dwelling on an existing foundation for the property located at 3721 39th St W in the R1A Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the application for variance at 3721 39th Street West to reduce the established front yard setback along Ewing Ave S from 40 feet to 38 feet, measured to the structure, subject to the following conditions:
  1. CPED review and approve final site plan, floor plans, and elevations;
  2. All site improvements shall be completed by June 19th, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
     3.    2120 49th Street West (BZZ #6593, Ward 13) (Shanna Sether)

Joe and Christy McElroy have applied for a variance to reduce the front yard setback along Oliver Avenue South from approximately 39 feet to approximately 9 feet to allow for a new rear addition on the second floor of an existing single-family dwelling on a reverse corner lot located at 2120 49th Street West in the R1 Single-Family District and SH Shoreland Overlay District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the above findings and approve the application for a variance to reduce the front yard setback along Oliver Avenue South from approximately 39 feet to approximately 9 feet to allow for a new rear addition on the second floor of an existing single-family dwelling on a reverse corner lot located at 2120 49th Street West in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by April 17, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3.  The exterior materials used for the addition shall be consistent with the exterior materials of the principal structure on the property.
     4.    5517 - 5547 Lyndale Avenue South and 603 55th Street West (BZZ #6585, Ward 11) (Shanna Sether)

Christopher Goring, on behalf of Mount Olivet Home, has applied for a variance to reduce the front yard setback along Lyndale Avenue South to allow for a new patio and trellis accessory to an existing board and care home/nursing home/assisted living facility located at 5517-5547 Lyndale Avenue South and 603 55th Street West in the R5 Multiple-Family District and PO Pedestrian Oriented Overlay District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the above findings and approve the application for a variance to reduce the front yard setback along Lyndale Avenue South to allow for a new patio and trellis accessory to an existing board and care home/nursing home/assisted living facility located at 5517-5547 Lyndale Avenue South and 603 55th Street West in the R5 Multiple-Family District and PO Pedestrian Oriented Overlay District, subject to the following conditions:
  1. Approval of the final site and landscape plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by June 19, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
     5.    566 36½ Avenue Northeast (BZZ #6586, Ward 1) (Shanna Sether)

Variance A: Kari Anderson has applied for a variance to reduce the front yard setback along 36 ½ Avenue Northeast from approximately 27 feet to approximately 25 feet for proposed second level cantilevers to an existing single-family dwelling located at 566 36 ½ Avenue Northeast in the R1A Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the above findings and approve the application for a variance to reduce the front yard setback along 36 ½ Avenue Northeast from approximately 27 feet to approximately 25 feet for proposed second level cantilever to an existing single-family dwelling located at 566 36 ½ Avenue Northeast in the R1A Single-Family District, subject to the following conditions:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by June 19, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The exterior materials used for the addition shall be consistent with the exterior materials of the principal structure on the property.
  4. Windows shall comply with section 535.80(c) of the zoning code.
Variance B: Kari Anderson has applied for a variance to reduce the front yard setback along 36 ½ Avenue Northeast from approximately 27 feet to approximately 20 feet for proposed second level cantilever to an existing single-family dwelling located at 566 36 ½ Avenue Northeast in the R!A Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the above findings and deny the application for a variance to reduce the front yard setback along 36 ½ Avenue Northeast from approximately 27 feet to approximately 20 feet for proposed second level cantilever to an existing single-family dwelling located at 566 36 ½ Avenue Northeast in the R1A Single-Family District.
     6.    3901 4th Avenue South (BZZ #6562, Ward 8) (Joe Giant)
     Staff report and written materials.
Jordan Kimball, on behalf of Jeff Quinn, has applied for a variance to reduce the established front yard setback along 4th Ave S from 30 feet to 28 feet to allow for the construction of a new single-family dwelling with attached garage for the property located at 3901 4th Ave S in the R1A Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the application for variance at 3901 4th Ave S to reduce the established front yard setback along 4th Ave S from 30 feet to 28 feet, measured to the structure, subject to the following conditions:
  1. CPED review and approve final site plan, floor plans, and elevations;
  2. A paved pathway will be constructed connecting the principal entrance with the public sidewalk along 4th Ave S.
  3. All site improvements shall be completed by June 19th, 2016 unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
     7.    3821 Portland Avenue (BZZ #6578, Ward 8) (Shanna Sether)
     Staff report and written materials.
Emily Norton and Eddie Rusting have applied for a variance to reduce the front yard setback along Portland Avenue from 20 feet to approximately 18 feet 3 inches to allow for an existing open porch to be enclosed on an existing single-family dwelling located at 3821 Portland Avenue in the R1A Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the above findings and approve the application for a variance to reduce the front yard setback along Portland Avenue from 20 feet to approximately 18 feet 3 inches to allow for an existing open porch to be enclosed on an existing single-family dwelling located at 3821 Portland Avenue in the R1A Single-Family District, subject to the following conditions:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by June 19, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The exterior materials used for the enclosed porch shall be consistent with the exterior materials of the principal structure on the property.
  4. Windows shall comply with section 535.80(c) of the zoning code.
