      1. 1101 3rd Street South (BZZ #6448, Ward 3) (Shanna Sether)
     Staff report and written materials and public comment.
Elizabeth Berres, of HCM Architects, on behalf of Valspar, has applied for a variance to increase the maximum sign height from 28 feet to approximately 43 feet 6 inches to allow for a new wall sign located at 1101 3rd Street South in the B4N Downtown Neighborhood District and DP Downtown Parking Overlay District.
Staff recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the above findings and approve the application for a variance to increase the maximum sign height from 28 feet to approximately 43 feet 6 inches to allow for a new wall sign located at 1101 3rd Street South in the B4N Downtown Neighborhood District and DP Downtown Parking Overlay District, subject to the following condition:
  1. Approval of the master sign plan by the Department of Community Planning and Economic Development.
 
2. 4725 27th Avenue South (BZZ #6272, Ward 12) (John Smoley)

Variance A: Daniel Hutnyak has applied for a variance to reduce the front yard setback along 27th Avenue South from 45 feet to 8.1 feet to allow a deck greater than fifty square feet in area and projecting more than four feet into the required yard at 4725 27th Avenue South in the R1A/Single Family District, AP/Airport Overlay District, and SH/Shoreland Overlay District.
Staff recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the findings above and deny the Variance to reduce the front yard setback along 27th Avenue South from 45 feet to 8.1 feet at 4725 27th Avenue South in the R1A/Single Family District, AP/Airport Overlay District, and SH/Shoreland Overlay District.
Variance B: Daniel Hutnyak has applied for a variance to reduce the required interior side yard setback to the north from 5 feet to 1 foot to allow a deck greater than fifty square feet in area and projecting more than four feet into the required yard at 4725 27th Avenue South in the R1A/Single Family District, AP/Airport Overlay District, and SH/Shoreland Overlay District.
Staff recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the findings above and deny the Variance to reduce the required interior side yard setback to the north from 5 feet to 1 foot at 4725 27th Avenue South in the R1A/Single Family District, AP/Airport Overlay District, and SH/Shoreland Overlay District.
 
     3. 2722 47th Street West (BZZ# 6444, Ward 13) (Joe Giant)
     Staff report and written materials.
Variance A: Scott Busyn, on behalf of David Sampsell and Kathleen Heafy, has applied for a variance to reduce the required front yard setback along Upton Ave South from 25 feet to approximately 18 feet, measured to the structure for the property located on a reverse corner lot at 2722 47th Street West in the R1 Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the application for variance at 2722 47th St to reduce the required front yard setback along 47th Street West from 25 feet to approximately 18 feet, measured to the structure
Variance B: Scott Busyn, on behalf of David Sampsell and Kathleen Heafy, has applied for a variance to reduce the required front yard setback along Upton Ave South from 25 feet to approximately 10 feet, measured to the patio/pergola for the property located on a reverse corner lot at 2722 47th Street West in the R1 Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the application for variance at 2722 47th St to reduce the required front yard setback along 47th Street West from 25 feet to approximately 10 feet, measured to the patio/pergola.
Variance C: Scott Busyn, on behalf of David Sampsell and Kathleen Heafy, has applied for a variance to reduce the required front yard setback along 47th Street West from 25 feet to 10 feet, measured to the structure for the property located on a reverse corner lot at 2722 47th Street West in the R1 Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the application for variance at 2722 47th St to reduce the required front yard setback along Upton Ave South from 25 feet to 10 feet, measured to the structure, subject to the following conditions:
  1. Approval of the final site, elevation, and floor plans by the Department of Community Planning and Economic Development
  2. All site improvements shall be completed by March 20, 2016 unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
 
4.   4023 Ewing Avenue South (BZZ #6452, Ward 13) (Andrew Liska)
Staff report and written materials.
Augustine Investment has applied for a variance to allow development on or within forty (40) feet of the top of a steep slope in the SH Shoreland Overlay District to allow for the construction of a new single-family dwelling at 4023 Ewing Avenue South.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the above findings and approve the application for a variance to Chapter 551, Article VI Shoreland Overlay District (551.470) at the property located at 4023 Ewing Avenue South, subject to the following conditions:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by March 20, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
 
5. 4533 Abbott Avenue South (BZZ #6453, Ward 13) (Shanna Sether)
Staff report, written materials and public comment.
Craig and Liz Haymaker have applied for a variance to reduce the north interior side yard setback from 5 feet to approximately 3 feet to allow for a second story addition to an existing single-family dwelling located at 4533 Abbott Avenue South in the R1A Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the above findings and approve the application for a variance to reduce the north interior side yard setback from 5 feet to approximately 3 feet to allow for a second story addition to an existing single-family dwelling located at 4533 Abbott Avenue South in the R1A Single-Family District, subject to the following conditions:
  1. The exterior materials of the addition shall match the existing dormer on the dwelling.
  2. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  3. All site improvements shall be completed by March 20, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
