Committee of the Whole Consent Agenda – February 20, 2014

1.   Land Sale – 2815 & 2819 Johnson St NE (Staff: Haila Maze)

Review for consistency with the Comprehensive Plan the sale of 2815 & 2819 Johnson St NE for the rehabilitation of the Hollywood Theater property for commercial tenant space.

Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

2.   Land Sales – 2201 Golden Valley Road and 1823 Penn Ave N (Staff: Jim Voll)

Review for consistency with the Comprehensive Plan the sale of 2201 Golden Valley Road and 1823 Penn Ave N for construction of new mixed-use multi-family development.

Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

Public Hearing

1.  Lake Nokomis Concessions Site and Beach Improvements (BZZ-6424, Ward: 11 and 12), 4955 West Lake Nokomis Parkway (Kimberly Holien).

Staff report

A. Conditional Use Permit: Application by The Minneapolis Park and Recreation Board for a conditional use permit to allow for a patio, walking path, trellis and retaining wall within 50 feet of the Ordinary High Water Mark at 4955 West Lake Nokomis Parkway.  The property is located in the R1, Single-family Residence district, the SH, Shoreland Overlay district, FP, Floodplain Overlay district and the AP, Airport Overlay district.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow a patio, trellis, walkway and retaining wall at the property located at 4955 West Lake Nokomis Parkway, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.  Mayo Clinic Square (BZZ-6375, Ward: 7), 600 Hennepin Ave (Hilary Dvorak). This item was continued from the January 13, 2014 meeting.

Staff report

A. Site Plan Review: Application by Robert Lux with Alatus, for a site plan review to allow modifications to an existing building for the property located at 600 Hennepin Ave.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow modifications to an existing building at the property located at 600 Hennepin Ave, subject to the following conditions:

  1. Approval of the final site, landscaping, elevation and lighting plans by the Department of Community Planning and Economic Development
  2. All site improvements shall be completed by March 3, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. A minimum of 27 bicycle parking spaces shall be provided on site.

3.  Mount Olivet Entrance/Elevator Addition (BZZ-6427, Ward: 13), 5025 Knox Ave S (Kimberly Holien).

Staff report

A. Conditional Use Permit: Application by Mount Olivet Lutheran Church has submitted an application for site plan review for a 1,400 square foot addition to the west side of the existing building at 5025 Knox Ave S.  The property is located in the R1, Single-family Residence district, the SH, Shoreland Overlay district and FP, Floodplain Overlay district.    

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow 1,400 square foot addition and site improvements to the property at 5025 Knox Ave S, subject to the following conditions:

  1. All site improvements shall be completed by March 3, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  2. CPED Staff shall review and approve the final site, elevation, landscaping and lighting plans before building permits may be issued.
  3. The crosswalks proposed within the parking lot shall extend through the drive aisles and connect to the public sidewalk along Logan Ave S to clearly guide pedestrian movements, in compliance with Section 530.130 of the zoning code. 

4.  Krause Liquor Store (BZZ-6425, Ward: 3), 80 Broadway St NE (Janelle Widmeier).

Staff report

A. Conditional Use Permit: Application by DJR Architecture, on behalf of Steve Krause, for a conditional use permit to allow a liquor store located at 80 Broadway St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the above findings and approve the application for a conditional use permit to allow a liquor store for the property located at 80 Broadway St NE, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. Vehicle access from Broadway St NE shall not be allowed, unless approved by the Public Works Department.

B. Site Plan Review: Application by DJR Architecture, on behalf of Steve Krause, for a site plan review to allow a new 1-story, approximately 7,700 square foot building located at 80 Broadway St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow a new 1-story, approximately 7,700 square foot building for the property located at 80 Broadway St NE, subject to the following conditions:

  1. The applicant is encouraged to plant street boulevard trees.
  2. Department of Community Planning and Economic Development staff review and approval of the final building elevations, floor, fixture, site, lighting and landscape plans.
  3. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by March 3, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

5.  Zoning Code Text Amendment (Ward: All) (Mei-Ling Anderson). This item was continued from the February 19, 2014 meeting.

Staff report

A. Rezoning: Amending Title 20 of the Minneapolis Code of Ordinances as follows:

Chapter 520 related to the Zoning Code:  Introductory Provisions

Chapter 535 related to the Zoning Code:  Regulations of General Applicability

Chapter 536 related to the Zoning Code: Specific Development Standards

Chapter 547 related to the Zoning Code:  Office Residence Districts

Chapter 548 related to the Zoning Code:  Commercial Districts

Chapter 549 related to the Zoning Code:  Downtown Districts

Chapter 550 related to the Zoning Code:  Industrial Districts

The purpose of the amendment is to allow additional sale and display of goods to be located outside of business establishments.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the above findings and continue the zoning code text amendment to the Planning Commission meeting of April 7, 2014.

6.  Zoning Code Text Amendment (Ward: All) (Shanna Sether).

Staff report

A. Rezoning: Amending Title 20 of the Minneapolis Code of Ordinances related to the Zoning Code, as follows:

Amending Chapter 520 related to Zoning Code:  Introductory Provisions

Amending Chapter 543 related to Zoning Code:  On-Premise Signs

The purpose of the amendment is to revise zoning code to allow on-premise roof signs.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the zoning code text amendment, amending Chapter 543 On-Premise Signs. Staff further recommends that Chapter 520, Introductory Provisions, be returned to the author.
