Staff report

A. Registered Land Survey: Application by Rick Collins, VP of Development with Ryan Companies US, Inc., for a final registered land survey for the properties located at 627, 701, 713 and 719 3rd St S, 500, 501, 521, 628, 700, 716 and 728 4th St S, 301, 329, 416 and 425 Portland Ave, 520 5th St S and 350 Park Ave.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the final registered land survey application for the property located at 627, 701, 713 and 719 3rd St S, 500, 501, 521, 628, 700, 716 and 728 4th St S, 301, 329, 416 and 425 Portland Ave, 520 5th St S and 350 Park Ave.

2. 1218-22 Como Ave SE (BZZ-6404, Ward: 2) (Kimberly Holien).

Staff report

A. Variance: Application by Pat Mackey, on behalf of CPM Development, for a variance to reduce the front yard setback along Como Ave from 22 feet (established) to 15 feet for the property located at 1218-22 Como Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission  adopt  the findings  and  approve the  application  for  a variance to reduce the required front yard setback from 23 feet to 15 feet for the properties at1218-22 Como Ave SE.

B. Variance: Application by Pat Mackey, on behalf of CPM Development, for a variance to decrease the corner side yard setback along 13th Ave SE from 12 feet to 7 feet for the property located at 1218-22 Como Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the east corner side yard setback from 12 feet to seven for the properties at Como Ave SE.

  1. The building setbacks, as shown on the plans submitted as part of the application, shall be provided.

C. Variance: Application by Pat Mackey, on behalf of CPM Development, for a variance to allow up to 37 percent of the required parking stalls to be compact for the property located at 1218-22 Como Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to allow up to 37 percent of the required parking stalls to be compact for the properties at 1218-22 Como Ave SE.

D. Site Plan Review: Application by Pat Mackey, on behalf of CPM Development, for a site plan review for a new 8-unit building located at 1218-22 Como Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission approve the site plan review application for a new eight-unit residential building on the properties at 1218-22 Como Ave SE, subject to the following conditions:

  1. All site improvements shall be completed by February 3, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  2. CPED Staff review and approval of the final site, elevation, landscaping and lighting plans before building permits may be issued.
  3. The street-facing entrance into the community room shall be eliminated to make the primary entrance more prominent, in compliance with Section 530.120 of the zoning code.
  4. The louvers proposed on the west elevation shall be decorative and shall be modified so that the location and size of the louvers align with the double-hung windows on the third floor.
  5. Two canopy trees shall be provided on site, in compliance with Section 530.160 of the zoning code.

3.  2500 University Ave NE (BZZ-6394, Ward: 3), (Shanna Sether). This item was continued from the January 13, 2014 meeting.

A. Variance: Application by Luke Derheim, on behalf of 2500 University LLC, for a variance to reduce the minimum front yard setback along University Ave NE from approximately 10 feet to 0 feet to allow for a two-story addition to an existing sit-down restaurant located at 2500 University Ave NE in the C1 Neighborhood Commercial District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the variance to reduce the required front yard setback along University Ave NE from approximately 10 feet to 0 feet to allow for a two-story addition to an existing sit-down restaurant located at 2500 University Ave NE in the C1 Neighborhood Commercial District, subject to the following condition:

  1. Approval of the final site, landscape and floor plans by the Department of Community Planning and Economic Development.

B. Variance: Application by Luke Derheim, on behalf of 2500 University LLC, for a variance to increase the maximum floor area of a single commercial use from 8,000 square feet to approximately 8,588 square feet for the property located at 2500 University Ave NE in the C1 Neighborhood Commercial District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the variance to increase the maximum floor area from 8,000 square feet to approximately 8,588 square feet to allow for a two-story addition to an existing sit-down restaurant located at 2500 University Ave NE in the C1 Neighborhood Commercial District, subject to the following condition:

  1. Approval of the final site, landscape and floor plans by the Department of Community Planning and Economic Development.

C. Site Plan Review: Application by Luke Derheim, on behalf of 2500 University LLC, for a site plan review for property located at 2500 University Ave NE in the C1 Neighborhood Commercial District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow for a two-story addition to an existing sit-down restaurant located at 2500 University Ave NE in the C1 Neighborhood Commercial District, subject to the following conditions:

  1. Approval of the final site, landscape and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by February 3, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The applicant shall provide additional transom windows along the north and west elevations or provide architectural detail or recesses in the proposed building wall to avoid blank, uninterrupted walls, not exceeding twenty-five (25) feet in length.
  4. Thirty percent of the walls of the proposed bar addition facing University Ave NE and the on-site parking area shall be windows.

4. Ceresota Building Residential Development (BZZ-6396, Ward: 7), 155 5th Ave S (Aaron Hanauer).

Staff report

A. Conditional Use Permit: Application by Kenneth Piper of Tanek Architecture, on behalf of the property owner, Ceresota Funding, LLC., for a conditional use permit to increase the height in the Downtown Height Overlay District from 6 stories or 84 feet to 9 stories, 115 feet for the property located at 155 5th Ave S.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use to increase the height of an addition in the Downtown Height Overlay District from six stories or 84 feet to 9 stories, 115 feet at 155 5th Ave S.

B. Conditional Use Permit: Application by Kenneth Piper of Tanek Architecture, on behalf of the property owner, Ceresota Funding, LLC., for a conditional use permit to allow an assisted living facility at the property located at 155 5th Ave S.

Recommended Motion: The  Department  of  Community  Planning  and  Economic  Development  recommends  that  the  City Planning Commission adopt the findings and approve the application for a conditional use to allow for an assisted living facility at 155 5th Ave S in the C3A Zoning District.

C. Site Plan Review: Application by Kenneth Piper of Tanek Architecture, on behalf of the property owner, Ceresota Funding, LLC., for a site plan review for the property located at 155 5th Ave S.

Recommended Motion: The Community Planning and Economic Development Department recommends that the City Planning Commission adopt the findings and approve the site plan review application for the property located at 155 5th Ave S subject to the following conditions:

  1. Approval of the final site, elevation, landscaping and lighting plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by February 3, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. Lighting levels shall meet the requirements outlined in Section 535.590 of the zoning code.
  4. Installation and maintenance of all landscape materials shall comply with the standards outlined in Section 530.210 of the zoning code.
  5. All solar systems that use a reflector to enhance solar production shall minimize glare from the reflector that affects adjacent or nearby properties. Measures to minimize nuisance glare include selective placement of the system, screening on the north side of the solar array, modifying the orientation of the system, reducing use of the reflector system, or other remedies that limit glare.

5. Northern Clay Center (BZZ-6377, Ward: 6), 2424 Franklin Ave E (Janelle Widmeier).

Staff report

A. Rezoning: Application by Faegre Baker Daniels LLP, on behalf of Northern Clay Center, for a petition to rezone the northern portion of the property located at 2424 Franklin Ave E from R6 Multiple-Family Residential District to C2 Neighborhood Commercial Corridor District.  (The remainder of the property is currently zoned C2.)

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the petition to rezone the northern portion 2424 Franklin Ave E from R6 Multiple-Family Residential District to C2 Neighborhood Commercial Corridor District.

B. Vacation: Application by Faegre Baker Daniels LLP, on behalf of Northern Clay Center, for a vacation of a no-outlet alley, which abuts only this property located at 2424 Franklin Ave E.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the application for the alley vacation for the property located at 2424 Franklin Ave E.
