Animals Disturbing the Peace

Noises from barking dogs and other pets can be a nuisance, and in certain circumstances it is against the law. Minneapolis City Ordinance 64.40, Nuisance or Disturbing the Peace, states:

No person shall own, keep, have in possession, or harbor any animal which frequently and habitually produces noise that unreasonably disturbs the peace, quiet, or repose of a person or persons of ordinary sensibility, provided that the provisions of this section shall not apply to duly authorized hospitals or clinics conducted for the treatment of small animals. Allowing an animal to create howling, barking, whining, meowing, squawking, or other such noises which are plainly audible across a property boundary or through partitions common to two (2) residences within a building and that take place continuously or repeatedly during a period of at least fifteen (15) minutes in duration between 7:00 a.m. until 10:00 p.m. or during a period of at least ten (10) minutes in duration between 10:00 p.m. and 7:00 a.m. shall be prohibited and subject to an administrative fine or other appropriate or authorized legal enforcement. The second subsequent violation of this section shall double the administrative fine and the third violation may result in an order for the animals to be removed from the City of Minneapolis. MCO 64.40

 

Please note: Barking considered in violation of this ordinance cannot be provoked.

MACC’s Response to a Complaint

1st ComplaintA form letter is sent out to the animal owner's property indicating that MACC has received a complaint of a dog's barking or other animal noise in violation of Minneapolis City Ordinance. The letter indicates the ordinance requirements, what they can do, and the consequences for a violation of the ordinance. The owner is given 7 days to address the issue before any additional action by MACC is taken.

 

2nd ComplaintA second form letter is sent out to the animal owner's property indicating that MACC has received a second complaint of a dog's barking or other animal noise in violation of Minneapolis City Ordinance. The letter repeats the ordinance requirements, what they can do, and the consequences for a violation of the barking ordinance. The owner is given an additional 7 days to address the issue before any further action by MACC is taken.

 

3rd ComplaintA MACC Animal Control Officer (ACO) is dispatched to the address to attempt to record any animal noises in violation of Ordinance. The ACO will park in such a manner so as not to incite or provoke the animal and will record for 10 minutes. If the ACO determines that the animal is disturbing the peace, as described in Ordinance 64.40 (producing noise that unreasonably disturbs the peace of a person of ordinary sensibility), a $200 administrative citation may be issued.

 

4th to 7th ComplaintsSame procedure as 3rd complaint, except any additional citation may be doubled for each subsequent violation up to $2,000.

 

If further investigation is deemed appropriate you may be asked to collect audio and/or video of the animals while in violation.
